I.                     PLEDGE OF ALLEGIANCE - Led by Supervisor Stocker

II.                   ROLL CALL - Supervisors Logue, Nicoletti, Griego, Schrader, Stocker

III.                 CONSENT AGENDA: All matters listed under the Consent Agenda are considered to be routine and can be enacted in one motion.

A.      Administrative Services

1.        Adopt resolution authorizing application with California Department of Transportation for state matching grant for FAA Airport Improvement Program Grant identified as AIP 3-06-0149-011 and accepting grant offer. (05-323)

2.        Award contract to Syblon Reid Construction, Inc. for Airport Water Pollution Control Facility and seal, coat and mark runway 14/32, approve change order No. 1 and 12 to reduce project costs within grant budget,  authorize Airport Manager to approve project change orders up to 10 percent of contract award,  and authorize Chair to execute same. B.       Auditor-Controller

1.        Authorize Budget Transfer for health refunds back to salaries in the various operating department for six months ending June 30, 2005. (05-325)

2.        Authorize Budget Transfer for health refunds back to salaries in the General Fund departments for six months ending June 30, 2005. (05-326)

C.       Clerk of the Board of Supervisors

1.        Appoint Ms. Sibby McCullough to the Developmental Disabilities Area Board III for a term to expire September 23, 2007. (05-327)

2.        Re-appoint Paula Aguilar-Ramos to Area 4 Agency on Aging Advisory Council for a term to expire June 30, 2007. (05-328)


D.      Community Development

1.        Adopt resolution declaring the County of Yuba's intent to consider a minor county boundary adjustment between County of Placer and County of Yuba - Hop Farm. (05-329)

E.       County Administrator

1.        Approve Public Defender contract with Law Offices of Benjamin Wirtschafter and authorize Chair to execute same. (05-330)

2.        Approve agreement with Bi County Ambulance Service for period July 1, 2005 through June 30, 2010 and authorize Chair to execute same. (05-331)

3.        Implement for Fiscal Year 2005/06 Budget Public Safety 1/2 cent sales tax revenue projection estimate to be $2.2 million after fire district and city distributions; any available Public Safety Fund 108 fund balance after close of Fiscal Year, meaning all expenditure paid and all encumbrances liquidated are available to Sheriff, District Attorney and Probation subject to Board approval and pursuant to any agreement among these departments; authorize County Administrator and Auditor-controller to develop process determining Fund 108 year-end balance that is acceptable to named departments and Board approval. F.       Public Works

1.        Adopt Resolution requiring Engineer's Report for Gledhill Landscaping and Lighting District. (05-333)

2.        Award Contract to Franza Enterprises Inc. for Road Improvement in County Service Area 19 and authorize Public Works Director to execute upon review and approval of County Counsel. (05-334)

3.        Authorize Budget Transfers in the amount of $1,568,401.00 to allocate additional revenue, reimbursements and expenses. (05-335)

4.        Approve plans and specifications and authorize to bid for the Powerline Road Safe Routes to School project. (05-336)

5.        Award of Contract to Tennis Court Specialists for replacing the tennis courts at Ponderosa Park and authorize Chair to execute same. (05-351)

G.       Sheriff-Coroner

1.        Approve agreement between the County of Yuba and Mr. Greg Tawney for developmental canine training services and authorize chair to execute same. (05-337)

H.      Treasurer-Tax Collector

1.        Authorize the transfer of unclaimed monies to General Fund Account No. #101-0000-371-9813 per Government Code §50055. (05-338)

2.        Approve discharging accountability for collection of taxes, penalties, cost and interest. (05-339)


A.      Present tenth graduating class of the Yuba-Sutter Microenterprise Training Program. (05-340)

V.                   PUBLIC COMMUNICATIONS: Any person may speak about any subject of concern provided it is within the jurisdiction of the Board of Supervisors and is not already on today's agenda.  The total amount of time allotted for receiving such public communication shall be limited to a total of 15 minutes and each individual or group will be limited to no more than 5 minutes.  Prior to this time speakers must fill out a "Request to Speak" card and submit it to the Clerk of the Board of Supervisors. Note:  No Board action can be taken on comments made under this heading.

VI.                 COUNTY DEPARTMENTS


A.      County Administrator

1.        Authorize Contingency Fund transfer in the amount of $182,736 to cover increased appropriations for Board Special, Board of Supervisors, Public Defender and Election Services. (05-341)

B.       Health and Human Services

1.        Approve Budget Transfer of funds in the amount of $195,000 from Account No. 100-5200-451-01-01 to Account Nos. 100-5200-451-23-01, 100-5200-451-26-00 and 100-5200-451-28-00. (05-342)

2.        Approve the lease agreement with Yuba County Office of Education located at One Stop Center commencing June 1, 2005 through May 31, 2010, and authorize Chair to execute same. (05-343)

VII.               ORDINANCES AND PUBLIC HEARINGS: If you challenge in court the action or decision of the Yuba County Board of Supervisors regarding a zoning, planning, land use or environmental protection matter made at any public hearing described in this notice, you may be limited to raising only those issues you or someone else raised at such public hearing, or in written correspondence delivered to the Yuba County Board of Supervisors at, or prior to, such public hearing.

A.      Ordinance - Hold public hearing, waive reading, and adopt ordinance amending Chapter 9 of the Yuba County Ordinance Code related to parking on Feather River Boulevard. (Land Use and Public Works Committee Recommends Approval) (Second Reading) (05-315)

B.       Ordinance - Hold public hearing, waive first reading, and adopt ordinance repealing and re-enacting section 2.25.010 of the Yuba County Ordinance Code relating to meetings of the Board of Supervisors. (First Reading) (Continued from June 14, 2005) (05-316)

PUBLIC COMMUNICATIONS:  Members of the public shall be allowed to address the Board of Supervisors on items not appearing on the agenda which are of interest to the public and are within the subject matter jurisdiction of the Board, provided that no action shall be taken unless otherwise authorized by law.  The total amount of time allotted for receiving such public communication shall be limited to a total of 15 minutes and each individual or group will be limited to no more than 5 minutes.


AGENDA ITEMS:  The opportunity of the public to be heard on an item shall be provided during the consideration of that item. In the interest of time, the Board has limited the length of such comment or input on each item to 15 minutes total, with a limit of no more than 5 minutes per person or group.  The period for public comments on a particular item may be extended upon a majority vote of the Board.  These time limits do not apply to applicants appearing before the Board on behalf of their applications.


ACTION ITEMS: All items on the Agenda under the headings “Consent,” “County Departments,” Ordinances and Public Hearings,” “Items of Public Interest,” and “Closed Session,” or any of them, are items on which the Board may take any action at this meetings.


PUBLIC HEARINGS:  All members of the public shall be allowed to address the Board as to any item which is noticed on the Board's agenda as a public hearing.  The Board has limited each person or group input to no more than 3 minutes.  Any person or group may provide the Board with a written statement in lieu of or in supplement to any oral statement made during a public hearing.  Written statements shall be submitted to the Clerk of the Board.


ORDINANCES:  Ordinances shall not be passed within five days of their introductions, nor at other than a regular meeting or at an adjourned regular meeting.  The Board of Supervisors will address ordinances at first readings.  The public is urged to address ordinances at first readings. Passage of ordinances will be held at second readings, after reading the title, further reading is waived and adoption of the ordinance is made by majority vote. An urgency ordinance may be passed immediately upon introduction. The Board reserves the right to amend any proposed ordinances and to hold a first reading in lieu of a second reading.


INFORMATIONAL CORRESPONDENCE:  The Board may direct any item of informational correspondence to a department head for appropriate action.


SCHEDULED LUNCH BREAK:  Between the hours of 12:00 noon and 1:00 p.m. and at the discretion of the Chair, the Board will recess one hour for lunch.


SPECIAL MEETINGS:  No public comment shall be allowed during special meetings of the Board of Supervisors, except for items duly noticed on the agenda.
